1. Use of Platform

Welcome to www.dheejewel.com ("Site" or "Dhee"). The website www.dheejewel.com is owned and operated by D’ATELIER DESIGNERS PRIVATE LIMITED (“Company” or “DD”), a company incorporated under the provisions of the Companies Act, 2013 with its registered office at:

No.25, Vigneshwara Apartments, 3rd Street, Parvathy Nagar, Rajakalipakkam, Tambaram, Chennai – 600073, Tamil Nadu, India.

Dhee and DD (the Company) are together referred to as (“DHEE” / “We” / “Us” / “Our” as applicable), and the Site and mobile applications are collectively referred to as the Platform. People (or Customers) who use this website shall be defined as (“User” / “You” / “Your” / “Customer”).

Any user who’s deemed to be ‘incompetent to contract’ by the Indian Contract Act, 1872 is not eligible to use this website. Anyone who is below 18 years of age shall not be allowed to become a member or to use, purchase, or enter into a contract through the website of DHEE.

‘Jewellery’ or ‘Jewels’ defines any jewels customized, designed, or pre-designed in any metals or in precious metals like Gold, Platinum, or Silver with or without stones or any precious elements and can also mean gold coins. ‘Stones’ defines any and every kind of precious and semi-precious stones, including diamonds, emeralds, pearls, etc.

You may be accessing our Site from a computer or mobile phone device (through an iOS or Android application, for example), and these Terms of Use govern your use of our Site and your conduct, regardless of the means of access. You may also be using our interactive services ("Interactive Services"), such as Customisation services, wherein you can customise the jewels or articles through our dedicated designers with whom you shall interact and express your interest and desire for any specific kind of design to be made exclusively for you subject to the cost based on your requirement, and these Terms of Use also govern your use of the Interactive Services.

These Terms of Use govern all the products offered on the Platform, including the Interactive Services. The Platform is only to be used for your personal non-commercial use and information. Your use of the services and features of the Platform shall be governed by these Terms and Conditions (hereinafter "Terms of Use") along with the Privacy Policy, Shipping Policy, and Cancellation, Refund, and Return Policy (together "Policies") as modified and amended from time to time.

By mere accessing or using the Platform, you are acknowledging, without limitation or qualification, to be bound by these Terms of Use and the Policies, whether you have read the same or not.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR UNCONDITIONAL AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT, SO PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.
If you do not agree to any of the terms enumerated in the Terms of Use or the Policies, please do not use the Platform.
You are responsible to ensure that your access to this Platform and material available on or through it are legal in each jurisdiction, in or through which you access or view the platform or such material.

DHEE reserves the unilateral right to change the particulars contained in the Terms of Use or the Policies from time to time and at any time, without notice to its users and in its sole discretion.
If DHEE decides to change the Terms of Use or Policies, DHEE will post the new version of the Terms of Use or the Policies on the Site and update the date specified above.

Any change or modification to the Terms of Use and the Policies will be effective immediately from the date of such upload of the Terms of Use and Policies on the Site.
Your continued use of the Platform following the modifications to the Terms of Use and Policies constitutes your acceptance of the modified Terms of Use and Policies whether or not you have read them.
For this reason, you should frequently review these Terms of Use, our Guidelines and Rules, and any other applicable policies, including their dates, to understand the terms and conditions that apply to your use of the Site.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve:
(a) transmissions over various networks; and
(b) changes to conform and adapt to technical requirements of connecting networks or devices.
Credit card information is always encrypted during transfer over networks.

The Site and all information displayed are owned by D’ATELIER DESIGNERS PRIVATE LIMITED and are protected by copyright and other intellectual property laws.
You may not modify, publish, transmit, transfer, sell, reproduce, create, distribute, repost, display, or in any way commercially exploit any of the content.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

3. Privacy Practices

We understand the importance of safeguarding your personal information, and we have formulated a Privacy Policy to ensure that your personal information is sufficiently protected.
Apart from these Terms of Use, the Privacy Policy shall also govern your visit and use of the Site.
Your continued use of the Site implies that you have read and accepted the Privacy Policy and agree to be bound by its terms and conditions.
You consent to the use of personal information by DHEE in accordance with the terms of and purposes set forth in the Privacy Policy, which may be subject to amendment from time to time at the sole discretion of DHEE.

4. Accounts and Registration

This Site is directed to be used by adults only.
We assume that any minor, if at all, accessing our Site is under the supervision of their guardians.
DHEE does not knowingly collect information from minors.
You will be responsible for maintaining the confidentiality of your account, password, and restricting access to your computer, and you hereby accept responsibility for all activities that occur under your account and password.

You acknowledge that the information you provide, in any manner whatsoever, is not confidential or proprietary and does not infringe any rights of a third party in whatsoever nature.
If you are accessing, browsing, and using the Site on someone else’s behalf, you represent that you have the authority to bind that person to all the terms and conditions herein.
In the event that the person refuses to be bound as the principal to the Terms of Use, you agree to accept liability for any harm caused by any wrongful use of the Site resulting from such access or use of the Site in whatsoever nature.

If you know or have reasons to believe that the security of your account has been breached, you should contact us immediately at the 'Contact Information' provided below.
If we have found a breach or suspected breach of the security of your account, we may require you to change your password, temporarily or permanently block or suspend your account without any liability to DHEE.

All the information provided by the users have to be true, accurate, detailed, current, and complete as required by the registration process of www.dheejewel.com.
We reserve the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, in our sole discretion, that it would be in DHEE’s best interests to do so.
You are solely responsible for all content that you upload, post, email, or otherwise transmit via the Site. The information provided to us shall be maintained by us in accordance with our Privacy Policy.

After registration, users may change their personally identifiable information, such as the login password, in their profile by logging into their account.
It is always advisable not to share your login details with anyone and to update the password at periodic intervals to keep it protected.

5. Product & Services Information

DHEE attempts to be as accurate as possible in the description of the product on the Platform.
However, DHEE does not warrant that the product description, color, information, or other content of the Platform is accurate, complete, reliable, current, or error-free.
The Site may contain typographical errors or inaccuracies and may not be complete or current. The product pictures are indicative and may not match the actual product. Any reliance on the material on this site is at your own risk.
However, users may expect more information regarding the product. In such a case, members can contact our customer care or support via email or toll-free number displayed prominently in the header or footer sections of the web page. We solicit your valuable feedback and suggestions.

DHEE reserves the right to correct, change, or update information, errors, inaccuracies, or omissions at any time (including after an order has been submitted) without prior notice.
Please note that such errors, inaccuracies, or omissions may also relate to pricing and availability of the product or services.

6. Product Availability

The website www.dheejewel.com may indicate availability of a product for sale by displaying its image.
However, an unforeseen situation of non-availability of the product may arise. In such a case, DHEE will endeavour to arrange it either from a third party or design it in any of its manufacturing units.
Prompt communication will be initiated by DHEE via email or phone.

Please take cognizance of the fact that for jewels or precious stones, regardless of the displayed information, sales can occur only based on the current availability of the product.
In such a case, actual prices may vary from the prices indicated on the site.

7. Product Customization

If a user requires a jewel exclusively designed to satiate their soul by performing modifications in the existing design (e.g., adding, removing, or changing the precious or semi-precious stones mounted on the ornament) or if they require a completely new design attributing to their interest or desire, they shall contact the sales or support team to discuss the possibility of customization.
Customization of a product or designing a new product may take time and shall be ascertained by DHEE.

The buyer must bear the customization cost fixed by the company.
Upon confirmation of the cost and time for delivering the customized product, and upon receipt of the advance amount prescribed by DHEE, the customization process will commence.

8. Product Use & Services

The products and services available on the Platform are for your personal use only.
The products or services that you may receive from us shall not be sold or resold for any commercial purposes.

9. Pricing Information

DHEE strives to provide accurate product and pricing information; however, errors may occur.
The product price is inclusive of the price of the material(s), designing or craftsmanship cost, making charges along with the wastage fee and Tax component.
DHEE has every right in determining the price of the product.

All prices quoted and displayed on the website are in INR (Indian National Rupees).
Though the price displayed on the website is the final price of the product covering the price of the metal, stones, value-added charges, handling charges (if applicable), and ‘tax,’ please be aware that the prices of jewellery fluctuate in accordance with international metal market trends. Hence, the final price may be subject to minor variations within the short span of making payment.
In such a case, you may have to pay a bit higher or lower than the price indicated on the site. Handling charges refer to the charges we may levy in case of unanticipated practical difficulties in delivery or due to higher rates of payment to the payment gateway.

The price of gold displayed as the gold rate is the price announced by the ‘Madras Jewellers & Diamond Merchants Association’ at Chennai for 22-carat gold. Kindly confirm the price before opting for the payment procedure.
However, DHEE puts continuous effort into updating the price listed on the website. DHEE reserves the right to alter the prices with or without notice.
The price of diamonds and precious stones is subject to the availability of the stones and will be based on market trends.

The weight of the product displayed on the website as ‘product weight’ is an approximate indication of the product’s weight, and the actual weight may vary slightly.
The price of the product is based on the indicated weight, and payment shall also be made for the same.
If the physical weight of the purchased product is lower than the indicated weight for which the payment is made, the difference of the amount corresponding to the difference in weight of the gold will be reverted back to the user account from which the payment has been made or will be sent back as a cheque and shipped to the customer along with the product.
The price of the gold, in this case, is calculated based on the market rate of gold that prevails on the date and time of purchase. This act of gesture by DHEE is purely in its interest toward customer satisfaction and shall not be considered a mandatory practice.

The price displayed and product details may be subject to typographical errors, though every reasonable effort is made to make the data free of such errors.
In such situations, users should clarify the price with the customer support team of DHEE. If the product price quoted, listed, or displayed on the website is higher than the actual price, DHEE will contact the member and inform them of the correct price for the selected Jewel.
Similarly, if otherwise, DHEE shall contact the user to inform them of the correct price and shall make an invoice for the informed price or cancel the order based on the customer’s interest.

Due to fluctuations in market prices, the price of metals (gold, silver, or platinum) and Gems/stones may vary from the time of order (or when added to the cart) and the time of purchase or payment.
The price at the time of purchase will surpass all other prices.

Unless the product ordered by you has been delivered and the services are availed, your offer will not be deemed accepted.
DHEE will have the right to modify the price of the product/service, contact you for further instructions using the email address or phone number provided during registration or order placement, or cancel the order and notify you of such cancellation.
In the event that DHEE accepts your order, the amount will be debited to your credit/debit card account and duly notified to you via email that the payment has been processed.
The payment may be processed before DHEE’s dispatch of the product that you have ordered. If we have to cancel the order (excluding any customised product) after we have processed the payment, the said amount will be reversed to your credit/debit card account.

If DHEE is unable to deliver the product to you on time or at all, you will be notified via email, and your order will be automatically cancelled due to the unavailability of the product.
DHEE shall not be liable to pay for any damages in such an event owing to the cancellation of the order or delay in delivery.

10. Return, Exchange & Refund Policy

DHEE strives to ensure the satisfaction of every customer who has purchased or ordered with it.
The process of returning and exchanging products purchased online via www.dheejewel.com is designed to be as simple and user-friendly as possible.

i) Terms for Return before Delivery:
If a customer prefers to return the product ordered or purchased before delivery for a valid reason, DHEE provides them with an option to do so, and this shall be considered as ‘Cancellation before Delivery.’ Check the cancellation terms section.

ii) Terms for Return on Defects:
Customers may return the delivered product if found to be defective upon arrival at the customer’s location.
Customers shall exercise this privilege only for genuine faults, and DHEE hopes the facility is not misused.
You are permitted to return jewels housing genuine wear, manufacturing defects, missing stones, or cracks on stones, provided the jewel is unused.
This must be reported to DHEE as ‘Defective upon Delivery’ on the date of delivery itself.
Return of jewellery is also reasonable and acceptable in cases where the jewel delivered to you is different from what was ordered if it remains unused.
DHEE reserves the right to determine if the product delivered can be considered ‘Defective upon Delivery.’

If the customer has tampered with the jewel deliberately, with or without the intention of usurping financial benefits, legal action will be taken under applicable laws for cheating, theft, forgery, etc.
In such an event, DHEE, apart from initiating legal actions against such customers, shall also penalize by not refunding the amount paid toward the purchase of the jewel.
Users should be aware that DHEE maintains every record—visual, factual, and legal—of the product that is shipped. Care should be taken while returning products via courier.
The product must be returned in the same condition as delivered by DHEE.

iii) Terms for Return on Dissatisfaction - Limited Duration

In case the customer is not satisfied with the product after receiving it, they can return the product within 15 days from the delivered date.
The return policy is subject to the following conditions:

a) The product should be returned in the same condition as delivered by DHEE.
b) Products showing signs of wear or engraved, altered, resized, or damaged may not be accepted and may be returned to the customer itself.
c) Products that are designed based on customer specifications, customized jewels, or gold coins can be exchanged, considering it as an old jewel and with appropriate pricing for the old jewel's market.
d) Once the return is confirmed by the support team of DHEE, DHEE will send a packaging cover through the courier agent, which has to be used to return the product.
The jewel to be returned must be properly packed as per the associated logistics company’s requirements.
e) The item has to be packed in front of the courier agent.
f) The product invoice provided by DHEE must be sent along with the jewel to be returned. Otherwise, the return process shall be void.
g) It is presumed that users are aware of jewellery and the right way of handling them before purchase.
DHEE shall not take responsibility for any wear or damage caused by inappropriate handling or improper placement.
Return, refund, or exchange of such products shall not be entertained by DHEE.
h) Once DHEE receives the jewel genuinely as stated above, the refund of the payment shall be promptly initiated within 15 days without deduction of shipping, processing fees, and bank transaction charges through internet banking or cheque to the bank account that was used for the purchase.

Once the refund process has been initiated, the amount will be directly refunded to your account via the same mode through which the transaction was made or through cheque.
(Amount would be refunded through cheque only in cases where the debit/credit card used by the customer while placing the order is not in use) within 15 days.

v) Terms for Exchange

In case you wish to exchange your item within 15 days from the date of purchase for an alternative product, we suggest that you return the product for credit and purchase the new product separately.

For any exchange of certain products, the user may confirm it with the support team of DHEE.
DHEE may offer complimentary free return shipping for the exchange of certain products. The user may confirm this with the support team of DHEE.

Customers may return the product for exchange within 15 days for the full invoice value.
The user shall bear the varied price of the new product purchased if its current invoice value is greater than the previously generated invoice value of the returned item(s).
If the current invoice value is lesser than the previous invoice value, DHEE shall process the difference amount to the source bank account of the customer.

Customized jewels and gold coins are not eligible for return shipping and shall be exchanged only as the old jewel.

For all transactions such as return, refund, and exchange, the price is determined by DHEE.
Products that show any sign of wear, tear, alteration, or tampering shall not be eligible for exchange or refund.
All returns, refunds, or money-back guarantees shall be paid to the customer through cheque or internet banking within 15 working days to the user’s purchased account after deducting any applicable transaction charges.

In case of alteration of customized jewels, the user shall bear the shipping (including return shipping), customization, or repair charges that may apply.

Repairs

In case the jewels bought need repair, the same shall be processed through the support team of DHEE.
The buyer has to follow the instructions as provided by the support team of DHEE, and said repair may carry charges based on the required repair to be made on such jewels.
The customer must produce the invoice of the purchase.

Insurance

Insurance is provided during the transit of every purchase.
The insurance will be valid when the merchandise is dispatched and will be void the moment following delivery to the respective customer or beneficiary.
This means the insurance becomes void or ceases once the receipt for delivery is acknowledged.

11. Shipping Policy

The management of DHEE is happy to provide secured shipping to customers for purchased orders.
The operations team and their associates strive to ensure the delivery is made accurately, in perfect condition, and on time.
At present, the delivery is available in selected towns/cities. However, on the customer's demand, with an additional shipping charge, shipment can be made for other cities or interior parts of some cities.
For some parts of the city, customers may have to visit the courier office to collect the shipments. Do confirm this with DHEE.
The user must provide the full name (as provided in proof), a detailed full address, and the recipient's (user) contact number. The proof of the recipient is verified with government-approved identity proof.

Shipment Procedure:

The shipment shall be delivered only to the specified delivery address confirmed by the user.
Customers have the option of changing the delivery address any number of times before the order is processed for shipment.
Once the shipment is processed, neither the specified receiver of the delivery nor the specified address for delivery shall be changed.
Any number of products ordered for a single delivery address will be bundled together and shipped as a single shipment.

In the case of shipping the ‘gifts,’ the beneficiary must produce their proof of identification recognized as identification proof by the Government of India.
The recipient's signature is considered acknowledgment and verification.

The support team of DHEE may contact you to confirm your address, availability, etc., before shipping the product.
The shipment can be tracked by the customer by checking with the courier agent.
We are not responsible for any delays caused by courier agencies and/or due to the time required for statutory clearances during the delivery process.

12. Cancellation Terms

Users will be informed if their order is aborted or cancelled either partially or fully, and the company may request additional information if required.
Cancellation of orders may happen either by the customer or by the company.

Cancellation from Customer:

To cancel an order, you have to send a cancellation notice via email, mentioning the Order ID.
Users can cancel the order for any genuine reason at any time, regardless of the shipment status.
Customized jewels shall not be entertained for cancellation before or after delivery.
We reserve the right to accept or reject requests for order cancellations for any reason.
The user agrees not to dispute the decision made by us and accepts our decision as final in this regard.

As part of usual business practice, if we receive a cancellation notice, the full invoice value will be refunded to you to the same bank account through cheque or internet banking from where the payment was originally effected.

Cancellation by Company:

Situations may arise where DHEE may not be in a position to accept an order and must cancel it.
DHEE reserves the sole discretionary right to refuse or cancel an order for any reason, which the management considers appropriate.
Reasons may include unavailability of the product, problems identified by credit and fraudulence investigations, or inaccuracies or errors in product or pricing information.

If the order is cancelled by the company after your credit/debit card is charged or payment is processed through internet banking, the charged/paid amount will be refunded to the same account.
Cancellation may be partial (e.g., one item out of multiple items purchased is cancelled) or in full. Customers will be informed, and DHEE will clarify any required details.

Fraudulent Transaction: DHEE reserves the right to reclaim product costs, processing charges, shipping costs, legal expenses, and other such costs from users involved in fraudulent transactions.

13. Mode of Payment

Payments for the products available on the Site may be made in the following ways:

Payments can be made by Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards, and reward points.
Credit card, Debit Card, and Net Banking payment options are instant payment options and recommended for faster processing of your order.
COD mode of payment is available for almost all pin codes within India on orders above INR ....

Note: We do not ship internationally currently.

14. Communications

DHEE is interested in connecting with customers and constantly promoting customer satisfaction by being receptive to their suggestions and feedback.
Feel free to contact our office if you require any clarification regarding the Terms and Conditions or the website and its contents. Our team will eagerly respond to your queries.

Electronic Communications:

DHEE may communicate with customers through email, SMS, telephone, WhatsApp, or other electronic channels provided by the customer.
By providing contact details, customers consent to the use of such information by DHEE for communication.
DHEE reserves the right to choose any appropriate mode of communication to interact with customers.

Customers can reach DHEE’s support team using the mail ID and toll-free number displayed in the header or footer sections of the website/app.
Customer support personnel are available from 10 am to 7 pm Indian Standard Time (GMT +5.30 Hrs).
Customer or sales support staff can educate users on the product or terms and conditions upon inquiry.

15. User Content

The information, photo, image, chat communication, text, software, data, music, sound, graphics, messages, videos, or other materials transmitted, uploaded, posted, emailed, or otherwise made available to us ("User Content"), are entirely your responsibility, and we will not be held responsible, in any manner whatsoever, in connection to the User Content.
You agree not to encourage, assist, or engage others as well as yourself in transmitting, hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any information that:

1. belongs to another person and to which the user does not have any right to;
2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, trolling, propaganda, or otherwise unlawful in any manner whatever;
3. harms minors in any way;
4. infringes any patent, trademark, copyright, or other proprietary rights;
5. violates any law for the time being in force;
6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
7. impersonates another person;
8. contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource;
9. threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offence, or prevents investigation of any offence, or insults any other nation.

DHEE shall in no way be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content.
DHEE does not endorse or control the User Content transmitted or posted on the Site by you; therefore, the accuracy, integrity, or quality of User Content is not guaranteed by DHEE.
You understand that by using the Site, you may be exposed to User Content that is offensive, indecent, or objectionable to you.
Under no circumstances will DHEE be liable in any way for any User Content, including, without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by you as a result of the use of any User Content transmitted, uploaded, posted, emailed, or otherwise made available via the Site.
You hereby waive all rights to any claims against DHEE for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with User Content.

You hereby acknowledge that DHEE has the right (but not the obligation) in its sole discretion to refuse to post or remove any User Content and further reserves the right to change, condense, or delete any User Content.
Without limiting the generality of the foregoing or any other provision of these Terms and Conditions, DHEE has the right to remove any User Content that violates these Terms and Conditions or is otherwise objectionable and further reserves the right to refuse service and/or terminate accounts without prior notice for any users who violate these Terms and Conditions or infringe the rights of others.

If you wish to delete your User Content on our Site or in connection with our mobile applications, please contact us by email at support@dhee.com and include the following personal information in your deletion request:
First name, last name, username/screen name (if applicable), email address associated with our Site and/or mobile applications, your reason for deleting the posting, and date(s) of posting(s) you wish to delete (if available).
We may not be able to process your deletion request if you are unable to provide such information to us.
Please allow up to 30 business days to process your deletion request.

16. Website Contents

Without any limitations, the texts, images, and all other content that includes the corporate logo, photographs, models, audio, video, the ‘look and feel’ of the website, the colour texture and coordination, the graphics, the software, the database, the user interface, the Graphical User Interface, promotional files such as images, audio tunes, video files, the designs, along with product designs and thereof shall collectively be called the ‘website content.’

The ‘website content’ is a creative work of DHEE, vendors, and corporate associates.
Any resemblance of the content with others is unintentional and coincidental.

17. Intellectual Property Rights

The "Dhee", "Dhee jewels", and "D’atelier Designers Private Limited" name and logo and all related product and service names, design marks, and slogans are the trademarks, logos, or service marks (hereinafter referred to as "Marks") of DHEE.
No trademark or service mark license is granted in connection with the materials contained on this Site.
Access to this Site does not authorize anyone to use any Marks in any manner. Marks displayed on this Site, whether registered or unregistered, are the intellectual property of DHEE.
DHEE shall not be held liable in any manner whatsoever for any unlawful, unauthorized use of the Marks.

DHEE expressly and exclusively reserves all the intellectual property rights in all text, programs, products, processes, technology, content, software, and other materials that appear on this Site, including its look and feel.
The compilation (meaning the collection, arrangement, and assembly) of the content on the Site is the exclusive property of DHEE and is protected by Indian copyright laws and international treaties.
Consequently, the materials on this Site shall not be copied, reproduced, duplicated, republished, downloaded, posted, transmitted, distributed, or modified in whole or in part or in any other form whatsoever, except for your personal, non-commercial use only.

No right, title, or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying, reproducing, duplicating, republishing, posting, transmitting, distributing, or modifying.
